Terms and Conditions

Important: These Terms and Conditions (“Terms”) form a legally binding agreement between you and AI ALGO TECH (“Company,” “we,” “us,” or “our”) regarding your access to and use of the Eacho website at eacho.ai, the Eacho mobile application (iOS and Android), and any related software, content, or services we make available (collectively, the “Services”). By accessing or using the Services, you agree to these Terms, our User Agreement, ourPrivacy Policy, and ourCookies Policy. If you do not agree, do not access or use the Services.

1. Who we are — and who we are not

Eacho is a technology product that provides software tools for automated and AI-assisted trading strategy selection, configuration, monitoring, and related features. AI ALGO TECH operates Eacho as a software provider.

We are not:

• a bank, broker-dealer, futures commission merchant, or exchange;
• a registered investment adviser, commodity trading advisor, or portfolio manager;
• your counterparty on any trade; or
• a provider of personalized investment, legal, tax, or accounting advice.

If you connect a brokerage or trading account, trades are placed, received, and executed (or rejected) by that third-party broker or platform undertheir terms, pricing, margin rules, and regulatory status. Your contractual and custodial relationship for trading and funds is with your broker, not with AI ALGO TECH.

2. Eligibility and restricted use

You may use the Services only if you: (a) are at least 18 years of age (or the age of legal majority where you live, if higher); (b) have legal capacity to enter a binding contract; (c) are not prohibited from using the Services under applicable law, including sanctions, export-control, or financial-services rules; and (d) will use the Services only for lawful purposes.

The Services are not available in all jurisdictions. Local law may prohibit or restrict automated trading software, forex/CFD products, leverage, marketing of trading tools, or cross-border financial technology. You are solely responsible for determining whether your download, account registration, strategy use, and trading activity are lawful in every jurisdiction that applies to you. We may refuse, suspend, geo-block, or terminate access where we believe use is unlawful, high-risk, or non-compliant.

You represent and warrant that you are not located in, ordinarily resident in, or accessing the Services from any jurisdiction where use of the Services would be unlawful, and that you are not a person with whom dealing is prohibited under applicable sanctions laws.

3. Accounts, credentials, and security

Certain features require an Eacho account and/or linking credentials or API access to a third-party broker or trading platform. You agree to provide accurate information, keep credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity occurring under your account, except to the extent caused by our willful misconduct where required by mandatory law.

You must not share accounts, circumvent access controls, or use another person’s identity, residency, or broker account without authorization.

4. Description of the Services; no performance guarantee

The Services may include strategy listings, AI-related models or logic, subscription options, educational or marketing content, account views, and tools that send instructions or preferences to connected platforms. Features may change, be limited by plan, or be discontinued.

No results are guaranteed. Any description of strategy behavior, historical performance, hypothetical results, AI capability, or “hands-free” operation is illustrative only. Markets change. Models can err. Connectivity can fail. Brokers can reject, delay, partially fill, or requote orders. You may lose money, including amounts greater than you expect when leverage is used.

5. Risk disclosure (forex, CFDs, and leveraged products)

Trading foreign exchange, contracts for difference (CFDs), and other leveraged instruments involves a high risk of losing money rapidly due to leverage. You can lose all capital allocated to trading and, depending on product and broker terms, may owe additional amounts. These products are not suitable for all investors. You should not trade with money you cannot afford to lose. Past performance is not a reliable indicator of future results. Hypothetical or backtested performance has inherent limitations and does not represent actual trading.

6. Acceptable use

You agree not to, and not to attempt to:

• violate any law, regulation, court order, or third-party right;
• use the Services where prohibited or after we have restricted your access;
• reverse engineer, decompile, scrape, overload, or interfere with the Services except as permitted by mandatory law;
• introduce malware, or probe or breach security or authentication measures;
• misrepresent your identity, location, eligibility, or affiliation;
• use the Services to manipulate markets, engage in fraud, or facilitate unlawful activity; or
• resell, sublicense, or commercially exploit the Services without our prior written consent.

7. Third-party services, brokers, app stores, and AI providers

The Services may interoperate with or reference third parties, including brokers, MetaTrader or other trading platforms, data vendors, cloud hosts (such as AWS), analytics providers, payment processors, and AI model providers. Third-party services are governed solely by those parties’ terms and privacy policies. We do not control and are not responsible for third-party availability, accuracy, fees, slippage, spreads, margin calls, liquidations, downtime, or content.

Downloads and in-app purchases may also be subject to Apple App Store, Google Play, and related payment terms. Where required by those platforms, those platform operators are third-party beneficiaries of applicable license restrictions.

8. Fees, subscriptions, and taxes

Some features may require payment. Prices, billing intervals, auto-renewal, free trials, and refunds are disclosed at purchase and/or governed by the applicable app store or payment provider. You are responsible for any taxes associated with your use of the Services, except taxes based on our net income.

9. Intellectual property

The Services, including software, models, interfaces, text, graphics, logos, and trademarks (including “Eacho”), are owned by AI ALGO TECH or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. No other rights are granted by implication or otherwise.

10. Privacy

Our collection and use of personal information is described in thePrivacy Policy. By using the Services, you acknowledge that policy.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY STRATEGY, SIGNAL, OR AUTOMATION WILL BE PROFITABLE OR SUITABLE FOR YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI ALGO TECH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR ANY TRADING LOSSES, MARGIN CALLS, LIQUIDATIONS, MISSED TRADES, OR SLIPPAGE, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence, where such exclusion is prohibited).

13. Indemnification

You agree to defend, indemnify, and hold harmless AI ALGO TECH and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your trading activity or broker relationship; (c) your breach of these Terms or applicable law; or (d) your violation of any third-party right.

14. Suspension and termination

We may suspend or terminate access to the Services immediately if you breach these Terms, create risk for us or others, or if we discontinue the Services or are required to do so by law or a platform partner. You may stop using the Services at any time. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnity, and dispute terms) will survive termination.

15. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. We will update the “Last updated” date when we post material changes. Continued use after changes become effective constitutes acceptance, except where mandatory law requires additional consent or notice.

16. Governing law and disputes

These Terms are governed by the laws applicable to AI ALGO TECH’s principal place of business, without regard to conflict-of-law principles, except that mandatory consumer-protection or financial-services laws of your country of residence may apply and cannot be waived. Courts located in that principal place of business will have exclusive jurisdiction over disputes, except where mandatory law gives you the right to bring claims in your local courts, or where a mutually agreed arbitration or alternative dispute process applies.

17. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms, together with the User Agreement, Privacy Policy, and Cookies Policy, are the entire agreement between you and us regarding the Services and supersede prior understandings on that subject.
